How is property divided if my spouse and I cannot agree?

Answer:
The court must divide the property in a way that is equitable, just, and reasonable.

This does not necessarily mean that the property is divided equally. The court must look at many factors in making a property distribution.

Some of the things that are considered to name a few are:

  • length of marriage
  • age of the parties
  • health of the parties
  • occupation of the parties
  • amount and sources of each party's income
  • assets and debts
  • each party's contribution to the family whether as a homemaker or otherwise, etc.
