Uncontested Divorce

If you and your spouse are in complete agreement as to all issues between you AND/OR you have already resolved all the marital issues in a Separation and Property Settlement Agreement, your case may be filed as an Uncontested Divorce.

Benefits of a DC Uncontested Divorce

This type of case moves through the court system in a much shorter period of time than a contested divorce case.

If you are both willing to cooperate with one another to complete the process, you will have a divorce hearing within a short period of time after filing the necessary papers.

How to file for an Uncontested Divorce in DC

You may file the Complaint for Divorce, Answer to the Complaint, Uncontested Praceipe, and Cross-Reference Intake Form together with the necessary filing fee and your case will then be scheduled for a hearing.

If you and your spouse both agree, you may file a Waiver of Appeal that will permit your divorce to be final immediately after your divorce Order is signed by the Judge at your hearing.

Cases are filed at the Domestic Relations Branch of the Family Court of the Superior Court of the District of Columbia located at 500 Indiana Avenue, NW, Washington, DC.

On your hearing day, you will need to present a certified copy of your marriage certificate.
